Kramer International Law Inc. and Kramer International Law, P.C. (collectively, “Kramer International Law,” the “Firm,” “we,” or “us”) collect, use and disclose personal information to provide legal services. We are committed to respecting confidentiality and professional secrecy in our client relationships. We process personal information according to the highest standards and in conformity with all applicable legal and regulatory requirements, including relevant privacy legislation and professional and ethical obligations governing lawyers.

This Privacy Policy (the “Policy”) has been written to help you understand how we collect, use and disclose your personal information. When you provide us with your personal information—whether through our websites, email, in person, over the telephone or by fax—you consent to the processing of your information as outlined in this Policy. You also authorize Kramer International Law and its third-party service providers to process your personal information for the purposes described below.

Kramer International Law is an international law firm. Unless we inform you otherwise, we are the “data controller” for your personal information. This means that we determine the purposes and means of the processing of personal information.

DEFINITION OF PERSONAL INFORMATION

Personal information means information about an identifiable individual.

Generally, personal information excludes business contact details used for communication in a business context, such as your name, position or title, type of business, and telephone and fax numbers.

  • Records of consent provided to us where such consent is needed for processing personal information.

Please do not send us any confidential information until we have confirmed in writing that we represent or act for you, your company, or your organization. If you or someone on your behalf sends us an unsolicited email or other unsolicited communication and you are not our client, a lawyer-client relationship is not thereby created. Such communications may therefore not be privileged and are subject to disclosure to third parties.

We do not intentionally collect information from individuals under 18 years of age. If you are a minor under age 18, please do not furnish us with any personal information unless you have consent from a parent or guardian. If we discover that we have collected personal information from a minor without verifying parental consent, we will take the necessary steps to delete that information.

If you intend to share personal information with us about others, you must obtain their permission before disclosing it to us.

HOW WE COLLECT PERSONAL INFORMATION

We collect your personal information directly from you and during our interactions with you, in particular while providing legal services to you and when you sign up for newsletters and seminars with us.

We may also receive personal information indirectly, for example through background screenings for job applicants.

Further, we collect personal information automatically through our websites, as described below.

We also collect personal information that is available publicly.

HOW WE USE PERSONAL INFORMATION

We use your personal information to provide and enhance our services and to comply with our legal and regulatory obligations.

CONSENT

We will obtain a client's consent for the collection, use, and disclosure of their personal information, as well as the consent of other individuals when required by law.

We presume that individuals who initiate contact with us or voluntarily share their personal information with us have consented to our reasonable collection, use and disclosure of their personal information for the purposes for which it was provided.

Furthermore, we presume that clients who engage our services and individuals involved in matters or proceedings adverse in interest to our clients consent to the reasonable collection, use, and disclosure of their personal information by us or our agents for the purposes of our representation of or providing legal advice to our clients.

If you furnish us with personal information pertaining to a third party, we trust that you will obtain all necessary consents to allow us to collect, use, and disclose that information for purposes set out in this Policy.

We do not collect, use, or disclose personal information without consent unless permitted or required by law. Situations not requiring consent include the following:

  • A client provides personal information to us respecting third parties for the purposes of our representation of or providing legal advice to the client;

  • Where a subpoena or court order is issued, or pursuant to rules governing production, a regulatory body or other authority compels production;

  • In the event we are investigating a contravention of the law or a legal duty or a breach of an agreement, obtaining consent would compromise the investigation or the exactitude of the personal information;

  • Where we are required by law to disclose personal information; and

  • Where the personal information is publicly available.

WHO WE SHARE PERSONAL INFORMATION WITH

Kramer International Law is an international law firm. As a result, any personal information we collect may be shared with and processed by any entity within our Firm.

We will use personal information only for the primary purpose for which it was collected, or for a compatible purpose.

We may disclose your personal information to meet legal or regulatory obligations or to protect or enforce our rights.

We may also disclose personal information to select third parties, such as:

  • For the purpose of representing our clients in the context of legal proceedings, such third parties may include opposing parties and their counsel, experts, witnesses, courts, judges, arbitrators and other decision-makers;

  • Service providers and vendors who assist us with various matters, including website development and maintenance, web hosting, marketing, and human resources. These providers may have access to or process personal information as part of the services they provide to us. We ensure that the information shared with these service providers is limited to what is reasonably necessary for them to perform their duties;

  • Governmental or law enforcement authorities, where the disclosure of personal information is required by law or we reasonably believe it to be so required; and

  • Third parties which may receive personal information that is transferred to them as part of our business assets in the context of a merger, acquisition, asset sale or similar transaction, or in cases of insolvency, bankruptcy, or receivership.

HOW LONG WE KEEP PERSONAL INFORMATION

We retain personal information only as long as it is reasonably necessary to fulfill the purposes outlined in this Policy and comply with our legal and regulatory obligations.

RIGHTS IN RELATION TO PERSONAL INFORMATION

You have specific rights regarding your personal information in accordance with applicable privacy and data protection laws. Without limitation, an individual may have the following rights:

  • ACCESS: Individuals have the right to inquire whether we are processing their personal information. If we are, they can request access to it. This allows the individual to receive a copy of the personal information we hold in their regard;

  • ACCURACY: We must take every reasonable step to ensure that the personal information we have is accurate, complete, up-to-date, and not misleading;

  • AUTOMATED DECISIONS: You may challenge any automated decision made by us where such decision has a legal or similar significant effect on you;

  • DATA PORTABILITY: You have the right to request the transfer of certain personal information to another party;

  • ERASURE: You have the right to request the deletion, destruction, or removal of your personal information. However, we may deny such requests in certain circumstances. For instance, we might deny a request if the personal information is necessary for us to comply with legal or regulatory obligations, is related to claims, or is required as part of a contract between the parties;

  • OBJECTION: You may object to our processing of personal information based on our legitimate interest or that of a third party, or for specific direct marketing purposes. Nonetheless, we may still be permitted to continue processing that information;

  • RECTIFICATION: You have the right to request the rectification of any inaccurate or incomplete personal information that we hold;

  • RESTRICTION OF PROCESSING: Individuals are entitled to request the suspension of processing of certain personal information, for example to establish its accuracy or the reason for its processing; and

  • WITHDRAWAL OF CONSENT: You have the right to request that we cease using or disclosing your personal information.

In addition to the above specific rights, you also have the right to lodge a complaint with a data protection authority in the country, state or province where you normally reside, where the Firm is based, or where there has been an alleged violation of privacy law.

Requests will be processed subject to exceptions under applicable privacy law. Such exceptions include information protected by lawyer-client privilege; information brought about during a formal dispute resolution process; information disclosed to law enforcement or other authorities that we must refrain from disclosing; or information respecting another individual where disclosure would divulge confidential commercial information.

WHERE WE STORE PERSONAL INFORMATION

Your personal information is currently stored in the US and Canada.

As an international law firm, we may store and process your personal information in any country where we have offices or facilities or where we engage third-party service providers. By providing your personal information to us, you consent to the transfer of that information to countries outside of your country of residence, which countries may have different privacy and data protection rules than your country of residence.

While your personal information is outside of your country of residence, it will be subject to the laws of the country in which it is stored. This means it may be disclosed to government authorities, law enforcement officials, or courts of that other country in accordance with local laws.

Where applicable, we will adhere to the requirements of the General Data Protection Regulation (GDPR). This includes ensuring that personal information transferred from the EU or EEA to third countries is adequately protected. To achieve this, we will implement appropriate safeguards, such as standard contractual clauses.

In addition, Kramer International Law will hold organizations or individuals outside the US or Canada responsible under US or Canadian law for any personal information transferred to them.

Notwithstanding the foregoing, our practices respecting your personal information will continue to be subject to this Policy.

SAFEGUARDS TO PROTECT PERSONAL INFORMATION

We subscribe to generally accepted standards of safeguarding the personal information provided to us, both during its transmission and after it is received. We take appropriate physical, technical, and administrative measures to safeguard personal information in our custody and control against loss, theft, unauthorized access, modification and disclosure.

Access to your personal information is restricted to personnel who have a legitimate business need to be informed of it, and who are bound by confidentiality obligations as part of their job responsibilities.

Further, we cannot guarantee the security of any information you transmit or provide to us, which you do at your own risk. Further, we cannot ensure that your personal information will not be accessed, disclosed, altered, or destroyed due to breaches in any of our physical, technical, or administrative safeguards.

OPTING OUT OF MARKETING-RELATED COMMUNICATIONS FROM US

If you no longer wish to receive marketing-related emails from us, you can unsubscribe by clicking the “unsubscribe” link located at the bottom of any such email you receive from us. We will make every effort to act on your opt-out request as quickly as possible. However, please allow a reasonable amount of time for your request to be processed.
